Welcome to ServSpark. These Terms of Service ("Terms") govern your access to and use of the ServSpark website located at servspark.com and any related services provided by ServSpark ("we," "us," or "our"). By accessing or using our website or services, you agree to be bound by these Terms.

1. Services

ServSpark provides digital marketing and lead generation services for home service businesses, including but not limited to: website design and development, review management, lead capture and nurture systems, missed call text-back, AI-powered response systems, Google Business Profile optimization, and related consulting services.

The specific scope of services will be defined in individual service agreements between ServSpark and each client.

2. Use of Website

You agree to use our website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the website in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any portion of the website or its systems
  • Use the website to transmit harmful, offensive, or illegal content
  • Interfere with or disrupt the website or servers connected to it
  • Use automated tools to scrape, crawl, or extract data from the website without permission

3. Booking and Consultations

When you submit a booking form or request a consultation through our website, you agree to provide accurate and complete information. Submitting a booking form does not create a binding contract for services. Service agreements are established separately upon mutual agreement between you and ServSpark.

4. SMS / Text Messaging Terms

By opting in to receive text messages from ServSpark, you agree to the following terms:

Consent and Opt-In

You may opt in to receive text messages from ServSpark by checking the appropriate consent checkboxes on our website forms. We offer two separate categories of messaging:

  • Transactional messages: Appointment reminders, booking confirmations, scheduling updates, and account-related notifications
  • Marketing messages: Promotional offers, service updates, tips, and other commercial communications

Each type of messaging requires separate consent. You may opt in to one, both, or neither.

SMS Consent Is Not Required

Consent to receive SMS messages is not a condition of purchasing any goods or services from ServSpark. You may submit forms, book consultations, and use our services without opting in to text messaging.

Message Frequency and Costs

Message frequency varies based on your interactions and account activity. Standard message and data rates may apply depending on your wireless carrier and plan. ServSpark is not responsible for any charges incurred from your carrier.

Opting Out

No Third-Party Sharing

We do not share your phone number, SMS consent data, or opt-in information with third parties for their marketing purposes. Your phone number and consent information is shared only with our SMS service provider for the sole purpose of delivering the messages you have consented to receive.

Supported Carriers

SMS messaging is supported on all major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and most regional carriers. Carrier support may vary and ServSpark is not liable for undelivered messages due to carrier issues.

5. Intellectual Property

All content on the ServSpark website — including text, graphics, logos, icons, images, and software — is the property of ServSpark or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

6. Client Websites and Content

When ServSpark creates websites or content on behalf of clients, the client retains ownership of their business-specific content (logos, photos, testimonials, etc.). ServSpark retains ownership of templates, code structures, and proprietary systems used to deliver services. Specific ownership terms are outlined in individual service agreements.

7. Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components. We do not guarantee specific results from our marketing services, as outcomes depend on many factors outside our control.

8. Limitation of Liability

To the fullest extent permitted by law, ServSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services. Our total liability for any claim arising from these Terms or our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless ServSpark and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of our website, violation of these Terms, or infringement of any third-party rights.

10. Termination

We reserve the right to terminate or suspend your access to our website at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Service agreements may have separate termination provisions.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Orange County, California.

12. Changes to These Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the website after changes are posted constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
